Welcome to ServeBot Rentals ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website at www.servebotrentals.com and our tennis ball machine rental services. By booking a rental or using our website, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age to rent equipment from ServeBot Rentals. By placing a booking, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

Minors under 18 may use the equipment only under the direct supervision of a renting adult who assumes full responsibility for their safety.

2. Equipment Description

We rent the Musketeer M5 tennis ball machine, a professional-grade, battery-powered ball machine with the following features:

  • Smartphone app and remote control operation
  • Multiple ball trajectories and shot combinations
  • Full court coverage
  • Battery-powered (no electrical outlet required)
  • Capacity of approximately 150 tennis balls

Each rental includes the ball machine, remote control, tennis balls, and a brief tutorial or instruction guide.

Additional Fees

  • Security Deposit: $300 (refundable — see Section 5)
  • Delivery Fee: $25 for delivery within 15 miles of Newton, MA
  • Late Return Fee: $50 per additional half-day beyond your rental period

All prices are in US Dollars and include applicable taxes unless otherwise stated.

4. Booking and Payment

4.1 How to Book

Bookings are made through our website at servebotrentals.com/book. You must provide your name, email, phone number, preferred dates, and pickup/delivery preference.

4.2 Payment Processing

All payments are processed securely through Stripe. We accept major credit and debit cards. By completing a booking, you authorize us to charge the rental fee plus the security deposit to your payment method.

Your payment information is handled directly by Stripe and is never stored on our servers. See our Privacy Policy for more details.

4.3 Booking Confirmation

After successful payment, you will receive a booking confirmation. Your booking is not guaranteed until payment is fully processed. Pending bookings that are not completed within 30 minutes will be automatically cancelled.

5. Security Deposit

$300 Refundable Security Deposit

A security deposit is charged at the time of booking to cover potential damage, loss, or unreturned equipment. This deposit is fully separate from the rental fee.

5.1 Refund Conditions

Your deposit will be refunded in full within 3 business days if:

  • The equipment is returned on time
  • The equipment is in the same condition as when received (normal wear and tear excluded)
  • All components are returned (machine, remote, balls, accessories)

5.2 Deposit Deductions

We may deduct from the deposit for:

  • Damage beyond normal wear and tear: Repair costs will be assessed and deducted
  • Missing components: Replacement cost of lost items (remote, balls, etc.)
  • Excessive cleaning required: $25 cleaning fee if equipment is returned excessively dirty
  • Late return: Late fees as described in Section 3

If damage or loss exceeds the deposit amount, you agree to pay the additional costs.

5.3 Total Loss or Theft

If the equipment is lost, stolen, or damaged beyond repair while in your possession, you will be responsible for the full replacement cost of the equipment (up to $1,200) less the security deposit already held.

Refunds are processed back to the original payment method through Stripe and typically appear within 5–10 business days.

7. Pickup and Delivery

7.1 Pickup

Pickup is available at our location in Newton, MA. The exact address will be provided in your booking confirmation. You must present a valid photo ID at pickup.

7.2 Delivery

We offer delivery within 15 miles of Newton, MA for a $25 fee. Delivery times are arranged directly with you after booking. You must be present to receive the equipment.

7.3 Return

Equipment must be returned at the agreed-upon time and location. If you chose pickup, return the equipment to the same pickup location. If delivered, we will arrange pickup at the same delivery address unless otherwise agreed.

8. Your Responsibilities

By renting equipment from ServeBot Rentals, you agree to:

  1. Inspect the equipment at pickup/delivery and report any pre-existing damage immediately
  2. Use the equipment properly and only for its intended purpose (practicing tennis)
  3. Follow all instructions provided in the tutorial, user manual, and app
  4. Not modify, disassemble, or attempt to repair the equipment
  5. Not use the equipment in wet or rainy conditions or with wet tennis balls
  6. Not leave the equipment unattended in a public location
  7. Not sub-rent or lend the equipment to others without your direct supervision
  8. Collect all tennis balls after your session and return them with the machine
  9. Keep the equipment secure — store indoors or in a locked vehicle when not in use
  10. Report any malfunction or damage to us immediately at (617) 334-5083

9. Assumption of Risk and Liability Waiver

⚠️ PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

9.1 Assumption of Risk

You understand and acknowledge that using a tennis ball machine and participating in tennis activities involves inherent risks, including but not limited to:

  • Being struck by tennis balls ejected from the machine
  • Muscle strains, sprains, fractures, or other physical injuries
  • Slips, trips, and falls on the court surface
  • Equipment malfunction
  • Injury to bystanders

By renting and using our equipment, you voluntarily assume all risks associated with its use, whether known or unknown.

9.2 Release of Liability

To the fullest extent permitted by Massachusetts law, you hereby release, waive, and discharge ServeBot Rentals, its owners, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action arising from personal injury, property damage, or death resulting from your rental and use of the equipment.

This release includes claims based on negligence but does not apply to claims arising from our gross negligence or willful misconduct.

9.3 Indemnification

You agree to indemnify, defend, and hold harmless ServeBot Rentals from any claims, damages, expenses, or legal fees brought by you or any third party (including anyone you allow to use the equipment) arising from your use of the equipment.

9.4 Medical Fitness

You confirm that you are in adequate physical condition to participate in tennis activities and use the equipment. If you have any medical conditions that could be affected by physical activity, consult your physician before renting.

10. Equipment Malfunction

If the equipment malfunctions during your rental period:

  1. Stop using the equipment immediately and contact us at (617) 334-5083
  2. We will attempt to troubleshoot remotely or provide instructions
  3. If the issue cannot be resolved, we will arrange a replacement or provide a pro-rated refund for the unused rental time
  4. Do not attempt to repair the machine yourself — doing so may void your deposit refund

11. Weather and Court Conditions

Tennis ball machines should not be used in rain, snow, or on wet courts. If weather prevents you from using the machine:

  • Contact us to reschedule at no additional charge (subject to availability)
  • If rescheduling is not possible, we will offer a credit for a future rental

Damage caused by use in wet conditions is not covered by the security deposit and will be the renter's full responsibility.

12. Limitation of Liability

To the maximum extent permitted by law, ServeBot Rentals' total liability to you for any claims arising from your rental shall not exceed the total rental fee you paid (excluding the security deposit). We are not liable for any indirect, incidental, special, consequential, or punitive damages.

13. Intellectual Property

All content on our website — including text, images, logos, and design — is the property of ServeBot Rentals and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any content without our prior written consent.

14. Modifications to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes arising from these Terms or your rental shall be resolved in the state or federal courts located in Middlesex County, Massachusetts.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ServeBot Rentals regarding your use of our services.
